Repeat offender never held driver's licence
A MAN who has never held a driver's licence decided to drive his partner's children home from the Christmas carnival after several schooners.
Scott Gray was fined $1180 for three charges in Murgon Magistrates Court on February 12.
Police prosecutor Barry Stevens said officers intercepted the man's vehicle at 9.30pm on December 15.
The police officers had noticed the vehicle's rear tail lights were not working.
"He said he had never held a licence and he was just driving his partner's kids home," Sgt Stevens said.
The court heard the concreter told police he had drank about six heavy schooners at the Proston Christmas Carnival before leaving.
Defence lawyer Tim Campion said the vehicle was owned by his son who was very intoxicated that night.
"He was taking his son's ute home to get everybody home, he was very embarrassed by this," he said.
Mr Campion said Gray normally gets a lift to and from work and does not drive.
He said the man was illiterate and could not sit the test for a driver's licence.
Magistrate Ross Woodford said he took into account the man's guilty pleas and lack of reading skills.
Gray was fined $600 for drink driving, and $130 for the tail lights causing the vehicle to be safe, but otherwise defective.
He was also fined $450 for being a repeat unlicensed driver.
The man is disqualified from holding a licence for six months.
Convictions were recorded for all three offences.
