No jail for sixth breach of domestic violence order
A MAN who has repeatedly contravened a domestic violence order has been told he would normally face jail, but Magistrate John Smith said he would give him one more opportunity to mend his ways.
Rodney Paul Doss, 43, was found to be staying in the home of his former partner after police were called to her home in regards to a disturbance on February 2.
A domestic violence order was in place that meant he could not live with his ex-partner and the court heard Doss had five previous convictions for contravening the order.
The court heard Doss and his ex-partner had been involved in an argument that night during which he had told her he wasn't supposed to be living with her.
He told police he had been living with his former partner for "some period".
The court heard Doss and his former partner had two daughters and he was afraid of losing contact with them, which was why he had decided to stay in the home.
Doss was fearful his former partner would withhold contact with the girls, because he had been unable to see them previously.
His former partner made requests to "repair the matrimonial home" and Doss was still supporting his family financially, the court was told.
Mr Smith told Doss he would normally be sentenced to between six and nine months in prison for breaching the domestic violence order.
Mr Smith said it appeared Doss had a great work history and said he had one last chance because he hated seeing people jailed.
Doss was fined $1500.
