Man avoids jail for breaching DV order

A NORTH Burnett man has been handed a two-month suspended jail sentence after he breached a domestic violence order and committed a public nuisance offence.

The man, who cannot be named for legal reasons, entered the premises of the victim while intoxicated and was aggressive.

The victim left the house and contacted police.

Upon their arrival, the defendant shouted profanities at the police officers.

The man pleaded guilty to the two charges when he appeared in Gayndah Magistrates Court on August 11.

The defence lawyer said it had been almost seven years between related offences by his client.

"My client admits to the facts presented,” the lawyer said.

"The actual breach I would say falls in the lower category.”

Magistrate Andrew Hackett told the defendant his behaviour was not acceptable.

He said the defendant's history of breaching orders dated back almost 20 years to 1997.

"On this occasion you were at the premises shouting and throwing plates,” Mr Hackett said.

"She was scared by what might come next.”

The magistrate gave him a two-month suspended jail sentence due to the time between related offences.

The man was also sentenced to a 12-month good behaviour bond.
