Man, 44, sentenced to eight years over rapes

UPDATE: A 44-YEAR-OLD man who supplied a teenage girl with drugs and alcohol before raping her inside his Bundaberg unit has been jailed for eight years.

It took a five-man, seven-woman jury about three hours to find the man guilty on three counts of rape - two of sexual intercourse and one of digital penetration.

The 16-year-old girl was just 14 when she and another friend - now 19 - visited the man at his Bundaberg unit on May 13, 2014.

The man was the father of the teenage girls' friend and was aware the victim was aged 14 as he'd met both teenagers on a handful of occasions before May 13.

During yesterday's sentencing the court heard the victim's troubling background made her vulnerable. Brought up in foster care, the teenager had self-harmed and suffered PTSD and depression.

On May 13 the victim and her friend visited the man's unit with the intention getting marijuana, which they did and smoked through the man's bong. The 44-year-old also bought the teenagers alcohol from a nearby bottleshop.

During yesterday's sentence in Bundaberg District Court Crown prosecutor Christopher Cook said the man took advantage of the 14-year-old.

"He exploited a young girl after she had alcohol and drugs and he exploited her for his sexual gratification," he said.

"His actions on May 13 where those of a predator."

The teenager sat in the back of the courtroom yesterday as Judge Michael Shanahan delivered the sentence.

"You forced her and her friend into the bedroom and had unprotected sex with both of them, switching between the two," he said.

The victim's friend did not make a complaint to police but gave evidence during the trial which supported the victim's version of events.

Judge Shanahan condemned the man's defence for implying the teenagers conspired to make up the incident and suggesting they committed perjury in giving evidence.

He also noted the man had a lengthy criminal history in three states.

The five-woman, seven-man jury returned their verdict about 6.10pm Tuesday, just three hours after they retired to consider the verdict.

The jury found the man had provided the then 14-year-old victim with drugs and alcohol before raping her in his Bundaberg unit on May 13, 2014.

The man was sentenced to eight years prison.

The teenager, who was 14 years old when she alleges the 44-year-old man supplied her and another friend, who was 17, with marijuana and alcohol at his unit on May 13, 2014.

The now 16-year-old alleges the man walked both teenagers to his bedroom and had sex with her without her consent.

The jury retired yesterday to consider a verdict but asked to rewatch part of the alleged victim's evidence and were still deliberating.
