Big Rigs Megatrans Exhibitor Packages Offer Giveaway (‘promotion’)

General

  1. The Promoter is The Queensland Times Pty Ltd (‘Promoter’) of 260 Brisbane Street, West Ipswich Queensland 4305. ABN 94 009 658 244. Telephone Number: 07 3623 1643. Authorised under Permit NSW/LTPS/18/23995.
  1. These terms and conditions relate to the Exhibitor Packages Offer Giveaway (‘promotion’).
  1. By purchasing an Exhibitor package at the Megatrans Truck Show (as defined in clause 10), participants accept these Terms and Conditions and the APNARM Advertising Terms and Conditions available at http://www.apn.com.au/advertising-terms/.
  1. If there is any inconsistency between these Terms and Conditions and anything else that refers to the Competition, these Terms and Conditions prevail. 
  1. By entering this competition, the participant consents to the Promoter using the participant’s names, addresses, telephone numbers and email addresses for determining the outcome of the competition and for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the participant. By opting-in, participants confirm that they allow their details to be used for this purpose.

Who can enter

  1. Entry to the Competition is open to and automatic for all participants who have purchased an Exhibitor package during the Megatrans Truck Show at the prevailing market rates shown at Clause 10; except employees and immediate families of the Promoter and their associated companies and agencies.
  1. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
  1. Participants must be 18 years of age or older as at the date of entry to be eligible to enter the competition.
  1. The Promoter reserves the right to request any winner to provide proof of identity and proof of residency at the nominated prize delivery address and /or proof of entry validity or proof of registration of business ownership in order to claim the prize. Proof of identity, business ownership and residency considered suitable for verification is at the discretion of the Promoter. In the event a winner cannot provide suitable proof, the winner will forfeit the prize in whole and will not be awarded cash in lieu of prizes.

  • Two-day high impact digital domination of the Big Rigs website with a Takeover during this offer;
  • A Big Rigs 25th Anniversary Merchandise Pack;
  • 65,000 impressions across desktop and mobile;  
  • Total cost of the Full-Page Package is RRP $26,019.28 (inclusive of GST).
  1. Half-Page Package
  • Exclusive sponsored interview with Big Rigs about the advertiser’s stall, distributed through Big Rigs’ social media channels to reach audiences; includes business Logo;
  • 13 insertions keeping the advertiser’s brand front of mind commencing in the Bi Rigs Expo Wrap-up feature;
  • Exclusive Editorial coverage in the Mega Trans Expo wrap up feature;
  • Two-day high impact digital domination of the Big Rigs website with a Takeover during this offer;
  • A Big Rigs 25th Anniversary Merchandise Pack;
  • 65,000 impressions across desktop and mobile;
  • Total cost of the Half-Page Package is RRP $15,477.58 (inclusive of GST).
  1. Quarter-Page Package
  • Exclusive sponsored interview with Big Rigs about the advertiser’s stall, distributed through Big Rigs’ social media channels to reach audiences; includes business Logo;
  • 13 insertions keeping the advertiser’s brand front of mind commencing in the Bi Rigs Expo Wrap-up feature;
  • Exclusive Editorial coverage in the Mega Trans Expo wrap up feature;
  • Two-day high impact digital domination of the Big Rigs website with a Takeover during this offer;
  • A Big Rigs 25th Anniversary Merchandise Pack;
  • Carousel during campaign;
  • Total cost of the Quarter-Page Package is RRP $9,460.79 (inclusive of GST).
  1. If a participant does not wish to be entered in to the competition, they must provide written notice to the Promoter at the address specified in Clause 1 prior to the end of the Promotion Period.
  1. Contestants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.

How to enter

  1. Free entry is automatically available to those participants who have purchased an exhibitor package at the prevailing market rate between Thursday May 10, 2018 and Friday June 1, 2018.
  1. Bookings for at least one Advertiser offer must run prior to Sunday July 1, 2018.
  1. Subject to these Terms and Conditions, the purchase of an exhibitor package will entitle the participant to one (1) entry into the competition.

Cancellations

  1.  One month's notice must be given if schedule is to be cancelled at which time a charge may occur for any expenses accrued by Big Rigs during campaign (cost of trip).   
  1. All cancellations must be confirmed in a written cancellation request which includes the business name, the date of cancelation as a minimum.

Taxes and Delivery Costs

  1. Any taxes and delivery costs which may be payable because of the participant purchasing an advertisement should seek advice from a suitably qualified tax professional about the applicable tax implications for them.

Prizes

  1. Individual prize value is up to $2,985.00 (inclusive of GST).  Total prize pool value is up to $2,985.00 (inclusive of GST) as at Thursday May 10, 2018.   The winner will receive the following prize:
  • One weekend for two people to the V8 Supercar event in New Zealand including flights, tickets and accommodation from Friday November 2, 2018 to November 5, 2018 (inclusive)
  • Economy flights from the winner’s closest domestic/international airport to Auckland, New Zealand;
  • Flights depart Australia on Friday November 2, 2018 and depart New Zealand to return on Monday November 5, 2018.
  • One-day attendance to the V8 Supercar event in New Zealand on Saturday November 3, 2018.
  • Any costs incurred over the value of the flight voucher and event package will be the responsibility of the winner.
  • Travel and accommodation prize must be used for the V8 Supercars Weekend in New Zealand.
  • Dates for travel, accommodation and events are non-negotiable and cannot be altered.
  • All participants should be available to travel between the dates shown in the listing at Clause 19.
  • Unless specified, any meals, beverages, gratuities, outings, excursions, hotel costs (other than specified) and any other incidental costs are at the winner’s expense. 
  • Accommodation is for room only and does not include any further inclusions or incidental costs.
  • The winner will be contacted to confirm their prize and the details of their flights and accommodation will be confirmed by the Promoter on the winner’s behalf.
  1. The prize is non-transferrable and cannot be exchanged for another prize, nor can it be redeemed for cash.
  1. The prize winner’s details will be published in Big Rigs on Friday June 29, 2018.

Draw and Notification

  1. The winner will be drawn via random electronic draw from all valid entries received in the promotion at Big Rigs Newspapers, Newscorp office, 28 Mayne Road, Bowen Hills on Monday June 4, 2018 at 10:00am AEST.  
  1. Upon validation and verification of the winning entry, the winner will be contacted by telephone and email within two (2) days of the draw.
  1. The Promoter’s decision in these proceedings is final and no correspondence will be entered in to regarding the outcome of the winner or any other decisions the Promoter makes about the competition.
  1. The winner must sign a Competition Release Form and provide evidence of identification and residence to secure their prize (unless otherwise advised by the Promoter).
  1. If the prize winner has not collected their prize by 5:00pm AEST Thursday June 14, 2018, the prize will be redrawn at Big Rigs, Newscorp office, 28 Mayne Road, Bowen Hills Queensland 4006 on Friday June 15, 2018 at 10:00am AEST. Redraw winners will be contacted by telephone/email within 2 days of this draw and names of winners published within 14 days of the draw.

Further Terms and Conditions

  1. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
  1. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  1. If for any reason this competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  1. Any participant found to be using any form of software or third-party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such a participant is awarded a prize and then found to have breached this clause, the participant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any participant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the participant has breached this clause.  A participant must provide any requested documentation to the Promoter upon request.
  1. A participant may not use a third party (including online competition entry site) to enter on their behalf, except where the participant needs to use those services of that third party to enter due to a disability.  If the preceding sentence has been breached, the participant will have all entries invalidated, any claim to any prize will be invalidated and where such a participant has already been awarded a prize before being found to have breached this clause, the participant must immediately return any awarded prize to the Promoter.  The Promoter has sole discretion to determine if this clause has been breached by any participant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the participant has breached this clause. A participant must provide any requested documentation to the Promoter upon request.
  1. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  1. The Promoter will make reasonable efforts to deliver prizes to the addresses provided by competition participants. If a prize is returned to the Promoter because it could not be delivered to the address provided, the Promoter cannot guarantee that it will be able to resend the prize to the prize winner.  The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.
  1. The Promoter reserves the right to redraw the prize if a participant who claims to be a prize winner is unable to satisfy these terms and conditions.

Copyright, Statutory guarantees, Waiver and liability

  1. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter publications or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  1. The Promoter acknowledges that the participant may own intellectual property rights (including copyright) in any material created or otherwise submitted to the Promoter in connection with the participant’s entry or participation in any aspect of the promotion (Works). The participant does not transfer their intellectual property rights to the Promoter by submitting an entry. The participant hereby grants the Promoter a non-exclusive, irrevocable, perpetual, worldwide licence to use the Works (including modifying, adapting or publishing the Works, whether in original or modified form, in whole or in part or not at all, to use, modify, delete from, add to, publicly display and reproduce, the photo(s), including without limitation, in any online media formats and through any social media channels, pages or accounts) for the sole purpose of running the promotion, promoting and celebrating the promotion and future promotions and agrees that the Promoter may assign and/or sublicense the Works to third parties for this same purpose.  Should the Promoter wish to use a participant’s Works for any other purposes, it will contact the participant to discuss licensing opportunities. The participant acknowledges and agrees that neither the participant nor any third party shall be entitled to any fee, royalty or other consideration in respect of such licence.  If the participant holds, now, or at any time in the future, any so called “droit moral” or moral rights in connection with the Works, the participant unconditionally and irrevocably consents, for the benefit of the Promoter and all of its assignees, licensees and sub licensees to minor alterations to the Works which may be required for print or display purposes such as resizing and minor colour correction  notwithstanding that such conduct may amount to derogatory treatment of the Works for the purposes of the Copyright Act 1968 (Cth) (Copyright Act). All participants consent to attribution by either full name or social media handle in satisfaction of their right to attribution under the Copyright Act.
  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
  1. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified.  However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
  1. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the participant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  1. All entries become the property of The Promoter (with the exception of any intellectual property rights comprised therein). All opt-in entries may be entered in a database and The Promoter may use the participant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the participant. By opting-in, participants confirm that they allow their details to be used for this purpose. If participants no longer consent to their details being used for future marketing purposes, the participant should contact The Promoter on their details set out below. Any request to update, modify or delete the participant’s details should be directed to The Promoter (see Clause 1).

Privacy

  1. The Promoter collects information about participants, including for example their name and contact details which they provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities they deal or interact with for example by using their services. We collect and use that information to provide participants with our goods and services, to promote and improve our goods and services, to provide them with targeted advertising based on their online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection.  We may disclose your information to our related companies, including those located outside Australia.  Any of us may contact a participant for those purposes (including by email and SMS) at any time.  We may also disclose a participant’s information to our service and content providers, including those located outside Australia. If a participant does not provide us with requested information we may not be able to provide them with the goods and services they require.  We may disclose their personal information to authorities if they are a prize winner or otherwise as required by law. Further information about how we handle personal information, how they can complain about a breach of the Australian Privacy Principles, how we will deal with a complaint of that nature, how they can access or seek correction of their personal information and our contact details can be found in our Privacy Policy at www.apnarm.com.au/privacy.
